We ran into a bit of a wall today on our initiative petitions, seems there was one sentence that upset the apple cart. What it did was temporarily upset the circulation to obtain registered signatures for a November ballot.
Bill Delaney our outstanding member from Toledo called and game me this news and said whatever glitch this contained, it will be fixed.
So to all, the next petition will be the one we will ask all registered Ohio voters to sign. I would expect this document (petition) will be available in short order.
We did get 3 of our members hearings with the local B.O.H. continued while we await the decision on our 5 members hearing one month ago today.
I believe the decision by the Hamilton County B.O.H. (which I am confident a positive ruling in favor of the defendants) will be a benchmark in defending these alleged and anonymous reports.
We are the ones who represent. Show our understanding of the BLPHA with e-mail, phone calls and attending our general membership meeting.

First, Happy Birthday, Kathleen Marie.
Second, don’t know for sure but early leaks point to the governor’s corner in taking the $230 million form the tobacco fund, we’ll know tomorrow for sure.
Also we know a proposal to ban smoking in Michigan has come south. The question on the table was no smoking except for the Casino’s as we get the story the legislators said all or none. The answer as we know is none. Smoking in Michigan, Indiana, Kentucky, West by God and Pennsylvania all smoke.
Wake up Ohio. This unfair law has cost the state as of March $733 million.
Keep this up and there will be NO state assisted programs. Do you think the hospitality industry would lay down to increases in taxes or raises in permit fees and wholesale liquor?
The answer is HELL NO!
Fix the existing problem with common sense legislation. The BLPHA will compromise but will not back down on 3794.
To protect this unfair law that is based on lies and a cash trail contributions our state government starting at the top need to realize we will not allow this law to take any more businesses and jobs.
We agree with taking the money, but we would also urge, give back the money all in state government have received from Robert Woods Johnson, A.C.S and health insurance.
Conglomerates to be accountable and to be true to your contribution, the lies and games are over and the worst part is costing Ohioans their businesses, their jobs and knowing their tax dollars mean nothing.
Our association supported the current state administration, unless this unfair law is acte4d upon swiftly not only will our support be erased, but a statewide organization of voters will make changes A.S.A.P.
We have lost enough to neighboring states and industry outside our country’s borders.
We don’t like it and will not put up with the path our state leaders our “leading” us down. The answer is not Keno, the answer is common sense.
We have given all and have gotten slapped in the face. Enough is enough. Join the BLPHA, the association that will get necessary changes done.

Please pay attention to the news the next couple of days. Tomorrow the 24th will be the hearings regarding $230 million dollar withdrawal from the big tobacco fund that has been on hold via a TRO by a Columbus judge.
The realism is the money should be left alone but the truism is this money will attempt to plug a budget that has so many holes in it. This dike (budget) became overly burdened do to the passage of ORC 3794.
If this money is not allowed to be taken the question is and has been since May 2007, where was it coming from to begin with. Anyone in our industry knows the answer.
The Nohioans that don’t know better understand if they believe that things aren’t going economically well at this time your property is next. The reason tax dollars were kept away from individuals is the hospitality industry has paid for all the programs due to tax dollars they gave back to the state.
There are only a few in Ohio that are in such an economic aloof scenario, this and the coming days might not affect them. The rest of us who haven’t yet decided to move, are going to make real choices, unless our representatives give back by pushing for reform in light of total collapse, Keno not being one of them, study our surrounding states.
We have solutions to handle this spiraling toilet Ohio is in.

Our beginning initiative petition presented to the Attorney General’s office has been certified as far as the starting issue has been met.
We have a scheduled hearing, pros, cons and whether this petition covers only one law revision. I’m very positive we have met the requirements to gather signatures, but we have to go through all the legal and necessary steps before we announce our next actions.
There will be NO mistakes along the way and when all conditions are cleared we will take the ball and run. I am still waiting for permit holders who have appeal hearings scheduled for this Friday, April 25th. Contact me immediately so we can cover our members and those who wish to join.
The hearing this Thursday freezing the State’s shifting money from the tobacco settlement to basically plug the very large hole in the budget should be very interesting.
Any communications on reported losses are needed to put our package together. If possible ask your state agency and beer distributors for their wholesale sale to on premise accounts. It will only help them to help us. We believe our information is decidedly proof of losses in our industry but all extra statements of loss since May 3, 2007 puts our package that much more certifiable.
Our efforts are finally getting recognized and our efforts will get this unfair law changed!

A big Thank You! to Connie and Steve from Mudpuppies in Lynchburg for hosting a very good meeting yesterday. Not only we receive 2 applicants but when all is settled and done we will welcome seven new members.
What made this so important, they set up a phone network and agreed to have monthly revolving meetings. Also they look to push to outlying counties and urge them (the permit holders) to join the BLPHA. I was overly impressed with their desire to organize. It is what all counties should do.
Call for a meeting, I’ll be more than happy to speak at any and all occasions to bring as many members. As the largest membership in the State our voice has and will make changes necessary for our survival. And it makes sense to join your working association.

If you or someone (permit holder) who has filed an appeal on an alleged anonymous citation and have a hearing scheduled for next Friday, April 25th, 2009, please contact my self or the office to help you with legal representation.
We will do what it takes to represent our membership.
Most should have received your renewal form in the mail by now. I would urge all if you have any changes such as name change, permit premise redefined, or goring from sole proprietor to an LLC or a corporation, wait until you receive your hard copy on or just before June 1st.
Once you receive the hard copy, then contact Department Liquor Control and make whatever changes necessary. Changes during the renewal process send red flags, plus they are pounded with the applicants.
Believe me; you can save yourself a lot of problems. If you have any questions call me with any situation you might have with your renewal.
The BLPHA is your helping hand. Your membership is valued and we will keep working to help permit holders in all aspect of your daily business.

We still have not received any decision on our five members who appealed their alleged anonymous complaints with a fine kicker. Also I have not heard of any individual being cited for smoking in a (public) or private business.
No other “Keno” information except this attempt to ramrod legislatively has run into serious roadblocks after emergency measures were railroaded to stop skill games, it almost appears tyrannical governing with no sense what it does to the citizens is and has been taking place.
You would think that any and all suggested public affected, legislation a call out to people in the know might help. I will shout out to Senator Seitz for his immediate response to Senator Schuler for his accommodating all our inquires and to Senator Kearney for his interest to help these Senators represent Nohioans in our area should be proud of how they keep our best interests in the forecast.

Our meeting last night was informative and could have been better attended.
Special thanks to Jim from O’Neal’s and Norma from Our Place for greatly helping our legal fund.
Anyone and all permit holders in the Lynchburg Hillsboro area plan to be at Mudpuppies in Lynchburg on Sunday @ 2:00 (This Sunday). I will talk to all permit holders on the status of the unfair law with appeal process and hopefully sign up more members joining the BLPHA.
We need help and support from the Highland, Brown and Clinton county areas. We are look for fund raising ideas from our membership and have had suggestions from a Fall Dance, A BLPHA Summer Picnic and a day at River Downs. Any and all ideas will be warmly welcomed, please contact the office or me. Your support at this time is needed to help will all of our efforts.
Hope you all get a big return from Uncle Sam and the State of Nohio.

With a whole lot going on I would rather talk and maybe vent at tonight’s meeting.
I sure most understand and all with questions we’ll answer tonight.
The headlines Monday shows our presence. The loss in state sales tax, employee tax has forced the legislature actions. I would hope this plugging the dyke (no attacks please) is more than an indicator why the State of Nohio needs to address this issue immediately.
All of our movements are set in place.
